E-Signatures: Are They Just as Good as a Real Signature?

In our increasingly digitalized society, many services that previously had to be done in person are now handled electronically over the Internet or with mobile devices. Since 2000, consumers have been able to sign leases, purchase cars, and agree to contracts from the comfort of their homes on their computers. While this is far more convenient, some E-sign documents require multiple signings or the oversight of a notary. As most people who have used the Internet before already know, electronic signatures are often obtained by simply checking a box that says,” I accept.” The question is this: which e-sign documents require the presence of a notary, and how can a mobile notary help?

The History of E-Signatures

In the year 2000, Congress passed the Electronic Signatures in Global and National Commerce Act (E-SIGN). This law was passed to ensure that electronic signatures were legally recognized. It stated that statements and contracts could not be denied solely because they were signed electronically. As long as the necessary disclosures are provided to the consumer electronically, checking a box that says something along the lines of “I have read and agree to the terms and conditions,” is an appropriate way to obtain a legal acknowledgement of said disclosures.

To support this federal law, many states have passed additional laws to solidify the legality of electronic signatures. As long as the electronic contract, transaction, or terms of services are lawful, any electronic signature or record is lawful as well.

The problem is that certain documents and services, such as wills, trusts, deeds, and mortgage closings still require the presence of notaries and witnesses.

Recent surveys have shown that most consumers prefer E-signatures, both because of its convenience and because it gives them more time to understand the fine print of the agreement.
